YORK ANTWERP RULES 2016 ENTER INTO FORCE IN TURKEY

The Turkish Commercial Code’s sub-section titled General Average makes specific reference to the York Antwerp Rules in stipulating that the most recent version of the Rules with an official Turkish translation shall be applicable in general average under Turkish law. In this sense, Turkish law differs from interpretations in different jurisdictions where the 2004 Rules are not considered an amendment to the 1994 Rules. The approach in the Turkish Commercial Code implies that each set of rules are an iteration of the preceding set of rules and shall replace the former rules once the official Turkish translation of the new set of rules is published.

The official Turkish translation of the York Antwerp Rules 2016 has been published in the Official Gazette on 19 February 2019. From this date onwards, general average under Turkish law will be subject to the York Antwerp Rules 2016.
