NEW PARENTAL LEAVE RIGHTS UNDER THE AMENDED LABOUR CODE:
he Labour Code numbered 4857 has been amended with the Amending Law numbered 6663 adopted on 29.01.2016, which was published in the official gazette dated 10.02.2016 and numbered 29620. The changes brought as to the parental rights of the employees are attention grabbing as they expand the scope of the entitlements of the new parents.

TURKEY RATIFIES THE ADDITIONAL PROTOCOL TO THE CONVENTION NO. 108 ON DATA PROTECTION:
It continues to be a dynamic year in terms of data protection for Turkey since after our previous Client Alert the Parliament has now ratified the Additional Protocol to the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data.

A NEW ERA FOR DATA PROTECTION IN TURKEY: THE LAW ON THE PROTECTION OF PERSONAL DATA ENTERS INTO FORCE:
On 7 April 2016, the Law has entered into force upon its publication in the Official Gazette. Whereas Turkish data protection law previously depended on scattered provisions of privacy in various codes and regulations, the Law will provide the general framework for the protection of personal data henceforth.

PARLIAMENT FINALLY PASSES THE LONG AWAITED DATA PROTECTION LAW:
The Turkish Parliament finally passed the long-awaited Law on the Protection of Personal Data which is to set forth the general framework on data protection and it currently awaits for presidential approval before being published in the Official Gazette. Meanwhile, we would like to provide an overview of the data protection landscape in Turkey before the framework data protection law enters into force.

TERMINATION OF EMPLOYMENT AGREEMENTS IN LIGHT OF ART. 435 OF THE CODE OF OBLIGATIONS NO. 6098:
IT HAS LONG BEEN ESTABLISHED IN THE TURKISH LABOUR LAW UNDER ART. 109 OF THE TURKISH LABOUR CODE NO. 4857 THAT ALL NOTIFICATIONS UNDER THE LABOUR CODE MUST BE MADE IN WRITTEN FORM, INCLUDING THE NOTICES OF TERMINATION OF EMPLOYMENT AGREEMENTS.
